Welcome to Amwaly. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Amwaly mobile application, website, services, and all related platforms (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree with any part of the Terms, you may not use the Platform.


1. Acceptance of Terms

By creating an account, using the services, or accessing any content provided by Amwaly LLC ("Amwaly", "we", "our", or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old to use Amwaly.


2. Description of Services

Amwaly provides a digital financial platform that allows users to:

  • Store multi-currency balances (e.g., USD, LYD).

  • Send and receive funds.

  • Invest in cryptocurrency and stocks.

  • Convert currencies instantly.

  • Access virtual or physical payment cards.

  • Perform peer-to-peer transactions and business payments.

Certain features may be restricted depending on your country of residence, citizenship, or regulatory status.


3. User Accounts

  • You must register for an account using a valid mobile number.

  • You are responsible for maintaining the security of your account, including OTPs, passwords, and multi-factor authentication methods.

  • You agree to provide accurate, complete, and updated information during registration and at all times.

Amwaly reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.


4. Identity Verification (KYC/AML)

To comply with anti-money laundering (AML) and counter-terrorist financing (CTF) regulations, we may require you to:

  • Submit government-issued ID.

  • Provide proof of address.

  • Complete liveness checks or facial recognition.

  • Verify source of funds.

Failure to complete KYC verification may result in account restrictions, suspension, or reporting to financial authorities.


5. Financial Transactions

  • All transactions on Amwaly are subject to approval and internal review.

  • We may place limits on daily, weekly, or monthly transfers.

  • rates are updated periodically and may include a spread or fee.

  • You are solely responsible for ensuring recipient information is accurate.

  • Transaction history may be made available via your dashboard.

We reserve the right to reverse or withhold any transaction suspected of fraud or abuse.


6. Investment Services

Investing in stocks and cryptocurrencies involves risk, including possible loss of capital. Amwaly does not guarantee any returns and is not a licensed financial advisor.

  • We do not offer personalized investment advice.

  • Regulatory status of investments may vary depending on your jurisdiction.


7. Fees and Pricing

  • Amwaly may charge fees for certain services (e.g., currency conversion, card issuance).

  • Fee schedules are available within the app and are subject to change with prior notice.

  • Zero-fee offers may be promotional and time-limited.


8. Restrictions on Use

You agree not to use the platform:

  • For any unlawful, deceptive, or fraudulent activity.

  • To impersonate another person or entity.

  • To send or receive funds associated with illegal goods or services.

  • To manipulate or bypass security or authentication measures.

  • To harass, abuse, or harm any user or employee of Amwaly.


9. Intellectual Property

All content, branding, and software used by Amwaly are protected under applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without prior written permission.


10. Termination

Amwaly may suspend or terminate your account at any time, with or without notice, if:

  • You breach any clause in these Terms.

  • We suspect illegal or fraudulent activity.

  • Required by law enforcement or regulatory bodies.

Upon termination, your access to the platform and any remaining balance may be subject to additional verification or forfeiture.


11. Disclaimer of Warranties

Amwaly provides the services “as is” and “as available”. We do not warrant:

  • That the services will be uninterrupted or error-free.

  • That the platform will be free of viruses or harmful components.

  • The accuracy, completeness, or reliability of any information provided.

Use of the platform is at your own risk.


12. Limitation of Liability

To the maximum extent permitted by law, Amwaly shall not be liable for:

  • Loss of funds or assets due to user error, theft, or unauthorized access.

  • Investment losses.

  • Any indirect, incidental, punitive, or consequential damages.


13. Indemnification

You agree to indemnify and hold harmless Amwaly, its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, or expenses arising out of your use of the platform or violation of these Terms.


14. Third-Party Services

Amwaly may use third-party providers for identity verification, payment processing, and other functions. By using our services, you agree to their terms and acknowledge that we are not liable for their performance.


15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, United States, unless otherwise required by applicable jurisdiction.

Disputes must first be resolved through good-faith negotiation. If unresolved, they may be submitted to binding arbitration or a court of competent jurisdiction.


16. Updates to Terms

We may update these Terms from time to time. You will be notified through the app or via email. Continued use of the platform after changes constitutes acceptance of the new Terms.
